How To File A Complaint
Any person may file a complaint with the Registry, if he or she believes a violation of the campaign finance law has occurred or is about to occur. Complaints must be made in writing, and statements in a complaint must be sworn to and signed in the presence of a notary, under penalty of perjury. The Registry’s brochure How to File a Complaint more fully describes the Complaint process.
A complaint that meets the requirements of the Registry’s Complaint procedure becomes public record only after all Respondents have been notified and given an opportunity to respond to the allegations. Upon service, a Respondent has fifteen (15) days in which to respond to a Complaint.
Complaint Procedures
When a complaint is received, the complaint will be reviewed by the Registry’s General Counsel for compliance with the requirements of
32 KAR 2:030(3). The complaint may be returned to the complainant for failure to meet any one of the technical requirements of 32 KAR 2:030(3); however, return of the complaint due to a technical deficiency does not constitute dismissal of the complaint. If a complaint meets the technical requirements for filing, Registry procedure provides that Respondents be served and have 15 days in which to respond before any Registry action, including dismissal, may be taken.
